The Council of State definitively annulled, on Thursday 29 December, the government order banning the sale of CBD flowers and leavesThe European Commission has already suspended the use of cannabis, the non-psychotropic molecule in cannabis, almost to the day a year ago.
On 30 December 2021, an interministerial order authorised the sale of CBD products with a THC content of 0.3 % or less, but at the same time prohibited the sale of flowers and leaves of the same cannabis with a very low THC content.
The Council of State was therefore seized by the industry, which suspended the government order banning the sale of hemp flowers and leaves on 24 January. It on the merits that the ban on this substance was disproportionate.
CBD flowers and leaves come in the same form as regular cannabis, usually as a dried green plant ready to be crumbled and smoked or used in infusions and other recipes.
Unlike traditional cannabis, which contains THC, CBD, which can already be sold as oil or herbal teais no longer considered, even in its smokable form, as a narcotic by the French justice system.
The decision states that the sale of CBD in leaf and flower form does not "create a risk to public health" that would justify its prohibition. "On the basis of the scientific evidence, the harmfulness of other molecules present in cannabis flowers and leaves, including CBD, has not been established."
The Council of State also argues that CBD has, according to scientific data, "relaxing and anti-convulsant properties, but does not have a psychotropic effect and does not cause dependence".
In response to the argument that it is impossible for the police and other law enforcement agencies to distinguish between CBD and THC plants when checking, which would undermine the fight against drugs, the Council of State ruled that the THC content "can be checked by means of rapid tests". There are indeed very quick tests that can tell you whether a flower has a very high THC content or none at all.
This decision was expected by more than 2,000 sellers of CBD products in France, whose flower sales account for about 75% of their income, and will now allow this sector to develop with more visibility and peace of mind.
